Proposed Internal Regulations
Applicable Personnel

These regulations apply to all trainees. Each trainee is deemed to accept the terms of this agreement when participating in any training provided by Feng Shui Tradition.

General Conditions
All trainees must comply with these regulations concerning the application of hygiene and safety rules, as well as the general and ongoing rules of discipline.

General Hygiene and Safety Rules

Each trainee must ensure their own personal safety and that of others by following, in accordance with their training, the general and specific safety instructions in force at the training site, as well as hygiene requirements.

However, in accordance with Article R.6352-1 of the French Labour Code, when the training takes place in a company or establishment that already has internal regulations, the hygiene and safety measures applicable to trainees are those specified in that internal regulation.

Furthermore, trainees sent to a company as part of their training are required to comply with the hygiene and safety measures set forth in the company’s internal regulations.

Proper Maintenance of Equipment

Each trainee is responsible for keeping the equipment entrusted to them for training in good condition. Trainees must use the equipment in accordance with its intended purpose; using the equipment for other purposes, including personal use, is strictly prohibited.

Depending on the training, trainees may also be required to devote the necessary time to the maintenance or cleaning of the equipment.

Use of Machines and Equipment

Tools and machines must only be used in the presence of a trainer and under supervision.

Any malfunction of machines or equipment, as well as any incident, must be immediately reported to the trainer responsible for the training session.

Fire Safety Instructions

Fire safety instructions, including a plan showing the locations of fire extinguishers and emergency exits, are displayed within the training facilities so that all trainees are aware of them.

Demonstrations or drills are conducted to verify the proper functioning of fire-fighting equipment and the understanding of evacuation procedures.

(Regarding this specific point, see Articles R.4227-28 and following of the French Labour Code)

Accidents

Any accident or incident occurring during training must be immediately reported by the injured trainee or by any witnesses to the person in charge of the training organization.

In accordance with Article R.6342-3 of the French Labour Code, any accident occurring to a trainee while on the premises of the training organization, or while traveling to or from the training, must be reported by the head of the training center to the relevant social security authority.

Alcoholic Beverages

Trainees are prohibited from entering or remaining on the premises while intoxicated and from bringing alcoholic beverages into the training facility.

Access to Beverage Stations

Trainees may access beverage stations serving non-alcoholic drinks, hot or cold, only during designated breaks.

No Smoking

In accordance with Decree No. 92-478 of May 29, 1992, which sets the rules for the prohibition of smoking in collective-use spaces, smoking is strictly prohibited in classrooms and workshops.

Schedules – Absences and Tardiness

Training schedules are set by the Management or the person in charge of the training organization and are communicated to trainees either by posting or during the distribution of the training program. Trainees are required to adhere to these schedules under penalty of the following provisions:

In the event of absence or lateness, trainees must notify the trainer or the administration office responsible for the training and provide a justification. Furthermore, trainees may not be absent during training hours except in exceptional circumstances as specified by the Management or the person in charge of the training organization.

For trainees who are employees undergoing training as part of a company training plan, the training organization must inform the employer in advance of any absences. Any absence or lateness not justified by specific circumstances constitutes a fault and may be subject to disciplinary action.

Additionally, for trainees who are job seekers receiving remuneration from the State or a regional authority, unjustified absences will result, in accordance with Article R 6341-45 of the French Labour Code, in a proportional deduction from their remuneration corresponding to the duration of the absence.

Moreover, trainees are required to complete or sign, regularly and as the training progresses, the attendance certificate, and at the end of the training, the training report as well as the certificate of training completion.

Access to the Training Organization

Unless expressly authorized by the Management or the person in charge of the training organization, trainees who have access to the organization to attend their training may not:

  • Enter or remain on the premises for any other purpose;
  • Introduce, have introduced, or facilitate the introduction of unauthorized persons into the organization, nor bring in goods intended for sale to staff or other trainees.

Dress Code and Behavior

Trainees are expected to present themselves at the organization in decent attire and to behave appropriately towards all persons present on the premises.

Information and Notices

Information is communicated through notices posted on the designated bulletin boards. Commercial advertising, political, union, or religious propaganda is strictly prohibited within the organization’s premises.

Organization’s Liability for Loss or Damage of Personal Belongings

The organization declines all responsibility in the event of loss, theft, or damage of any personal belongings left by trainees on its premises (classrooms, workshops, administrative offices, parking lots, locker rooms, etc.).

Sanctions

Any breach by a trainee of the provisions of this internal regulations may result in a sanction.

A sanction, within the meaning of Article R.6352-3 of the French Labor Code, is any measure—other than verbal warnings—taken by the person in charge of the training organization, or their representative, following an act by the trainee deemed by them to be improper. Such a measure may affect, immediately or later, the trainee’s presence in the training or compromise the continuity of the training they are receiving.

Depending on the severity of the breach, the sanction may consist of:

  • A warning;
  • A reprimand or formal notice;
  • A measure of permanent exclusion (it is reminded that in agreements concluded by the organization with the State or Region, specific provisions are defined for the application of the above-mentioned sanctions).

Fines or other monetary penalties are strictly prohibited.

The person in charge of the training organization must inform of the sanction:

  • The employer, when the trainee is an employee undergoing training as part of the company’s training plan;
  • The employer and the relevant joint organization that financed the training, when the trainee is an employee participating in training under a training leave program.

Disciplinary Procedure

The following provisions reproduce Articles R.6352-4 to R.6352-8 of the French Labor Code.

No sanction may be imposed on a trainee without first informing them of the allegations made against them.

When the person in charge of the training organization, or their representative, intends to impose a sanction that affects, immediately or later, a trainee’s presence in the training, the following procedure must be observed:

  1. The person in charge of the training organization, or their representative, summons the trainee, specifying the purpose of the meeting.
  2. The summons indicates the date, time, and location of the meeting. It must be in writing and sent by registered letter or delivered to the trainee against receipt.
  3. During the meeting, the trainee may be assisted by a person of their choice, either another trainee or an employee of the training organization.
  4. The summons must explicitly inform the trainee of this right. The person in charge of the training organization, or their representative, explains the reason for the proposed sanction and listens to the trainee’s explanation.
  5. In cases where permanent exclusion from the training is contemplated and a board of improvement (conseil de perfectionnement) exists, the board is convened as a disciplinary committee, including representatives of the trainees.
  6. The disciplinary committee is consulted by the person in charge of the training organization, or their representative, after the meeting described above, and provides an opinion on the proposed exclusion measure.
  7. The trainee is informed of this consultation and may request to be heard by the disciplinary committee. The trainee may be assisted in this context by a person of their choice, either another trainee or an employee of the organization. The disciplinary committee must submit its opinion to the Director of the organization within one clear day following its meeting.
  8. The sanction cannot be imposed less than one clear day or more than fifteen days after the meeting or, if applicable, after the opinion of the disciplinary committee has been submitted. The sanction must be communicated in writing, with reasons, either by a letter delivered against receipt or by registered letter.
  9. When the act has led to an immediate sanction (e.g., temporary exclusion or suspension), no final sanction related to that act may be imposed without the trainee first being informed of the allegations against them and, if applicable, without the procedure described above being followed.

Trainee Representation

For training courses lasting more than 200 hours, a primary trainee representative and a substitute trainee representative are elected simultaneously through a two-round single-member vote, according to the following procedure:

  • All trainees have the right to vote and be elected.
  • The vote takes place during training hours, no earlier than twenty hours and no later than forty hours after the start of the course.
  • The person in charge of the training organization is responsible for organizing the vote and ensuring its proper conduct. If trainee representation cannot be ensured, a report of vacancy is sent to the territorially competent regional prefect.
  • Representatives are elected for the duration of the training course. Their functions end if, for any reason, they cease to participate in the training. If both the primary and substitute representatives cease their functions before the end of the course, a new election is held.

Role of Trainee Representatives

Trainee representatives may make suggestions to improve the progress of the training and the living conditions of trainees within the training organization.

They present any individual or collective complaints regarding these matters, hygiene and safety conditions, and the application of the internal regulations.

They are entitled to communicate trainees’ observations to the board of improvement (conseil de perfectionnement), when one exists, on issues within the board’s competence.
